Michael Goldberg and Joseph Fried on How They Won $16.2M Verdict in Trial Against Amazon

Last August, a Georgia jury handed down a $16.2 million verdict at trial against Amazon for the injuries a child suffered when he was struck by a delivery van. That case was one of the first in the nation to go to trial over Amazon’s potential liability for the actions of its delivery partners.

The Georgia child suffered a severe leg injury when he was struck by the van. And the groundbreaking case focused both on Amazon’s training of its delivery van drivers and whether the company had enough control over its delivery service providers to be held responsible. Jurors ultimately apportioned 85% of liability to Amazon on the negligent training claim and 10% to the delivery service provider, and importantly, found Amazon held enough control over the delivery partner to render the online giant liable for that share of fault as well.

After the verdict, Fried Goldberg’s Michael Goldberg and Joseph Fried sat down for a 90-plus minute deep dive into just how they won the verdict. The wide-ranging discussion, complete with video from the trial, focuses on the winning approaches they used in this case, as well as powerful techniques that apply to any trial.

They discuss:

  • How they proved elements of control in the employer liability claim of the case.
  • Keys to cross-examining a sympathetic witness.
  • Best practices for questioning expert witnesses.
  • Arguing a system failure.
  • And so much more.
