In California Insurance Coverage Suit, Judge Urges Counsel to Deliver the Facts

At the conclusion of evidence in a California class action bench trial against Kaiser Foundation Health Plan Inc., Judge Wynn Carvill directs opposing counsel in their closing briefs to do more “heavy lifting” by detailing the facts surrounding the suit. The suit, involving more than 10,000 plaintiffs, accuses Kaiser of violating state insurance law by refusing to cover plastic surgery following gastric bypass procedures.
