Frank Bayuk tells jurors that James Hardin did not bear any of the hallmarks of cigarette addiction, such as withdrawal symptoms, and that he smoked by choice. Hardin, who smoked for decades, died in 2012. His wife, Joyce Hardin is suing Bayuk’s client, R.J. Reynolds, claiming the company’s concealment of smoking’s health hazards caused her husband’s COPD.
